Shop – terms, shipping and cancellation

1. Seller and scope

The seller is NOiSY – Alexander Werr, Parkstraße 26, 60322 Frankfurt am Main, Germany, email: hello@noisynode.org (see legal notice).

These terms apply to all orders in the NOiSY shop at noisynode.org/shop and noisynode.com.

2. Contract

Showing products in the shop is not yet a binding offer. By clicking the pay button on the payment page (Stripe), you make a binding offer to buy the goods in your cart. The contract is concluded as soon as the payment succeeds and we send you the order confirmation by email.

Until you click the pay button, you can change your cart or cancel at any time. You receive the order details and these terms with the confirmation email; you can open and save this page at any time.

3. Prices and payment

All prices are final prices in euros including statutory VAT, plus shipping. Shipping costs are shown in the cart and on the payment page before you order.

Payment is handled by our payment provider Stripe (card, PayPal, Apple Pay, Google Pay, Klarna and other methods shown). The amount is due with the order.

4. Pre-orders

Some products are first available only as a pre-order. The product page shows a goal (number of pieces) and a deadline.

  • You pay the full price when you pre-order.
  • If the goal is reached by the deadline, we produce the goods and ship them, expectedly within the period stated on the product page. We let you know by email.
  • If the goal is not reached by the deadline, no delivery contract for this product comes about: we refund the price (and the shipping, if the order consisted only of pre-orders) automatically and in full to your payment method and let you know by email.
  • If production is significantly delayed, we tell you. You can then withdraw from the purchase and get your money back.

Your statutory right of withdrawal (below) also applies to pre-orders.

5. Delivery

We deliver to Germany and the countries of the European Union. Items in stock usually ship within 3 working days after payment; delivery then takes 1–3 working days in Germany and 3–8 working days in the EU. As soon as your parcel is on its way, you get an email with the tracking number.

6. Retention of title

The goods remain our property until paid in full.

7. Warranty

The statutory warranty rights apply. If something arrives broken or wrong, please write to hello@noisynode.org – ideally with a photo.

8. Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

Cancellation policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take possession of the goods. For several goods in one order delivered separately, the period starts on the day on which you or a third party named by you take possession of the last item.

To exercise your right of withdrawal, you must inform us (NOiSY – Alexander Werr, Parkstraße 26, 60322 Frankfurt am Main, Germany, email: hello@noisynode.org) of your decision to withdraw from this contract by a clear statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
